The company Adara Home, S.L. (Tax ID: B44513034), registered in the Commercial Registry of Castellón, volume 1771, folio 158, sheet number CS 41483, entry 1, is the owner of this website, operating under the trade name Adara Home.

These general conditions are formulated in accordance with the Civil and Commercial Codes, Law 7/1996 of January 15 on Retail Trade Regulation, Law 7/1998 of April 13 on General Contracting Conditions, and Law 7/1995 of March 23 on Consumer Credit.
Placing an order implies the customer's acceptance of these General Terms and Conditions of Sale, as well as any others specified in the order itself.

Furthermore, the Adara Home customer declares to be of legal age and confirms that all the data provided for the management of their order is correct.

1. OBJECTIVE

These General Terms and Conditions of Sale aim to define the sales modalities between Adara Home SL and the customer, from order placement, delivery, and payment, as well as after-sales service.

2. ORDER

The CUSTOMER may place their order through the following means:

Via the email indicated on our website, info@adarahome.com.

To place an order, the Customer must provide their personal data, which will be stored in the Adara Home SL database. If they place another order, their data will not be requested again as they will have a password.

The placement of an order by the Customer implies full acceptance of the prices, product descriptions, and General Terms and Conditions of Sale, as well as any others specified in the order itself.

3. DELIVERY

Shipping costs are:

  • Mainland Spain and Portugal: €6, free from €75
  • France, Italy, Germany, Monaco, Austria, Belgium, Czech Republic, Denmark, Luxembourg, Netherlands, and Poland: €15, free from €85
  • Bulgaria, Croatia, Estonia, Finland, Hungary, Ireland, Latvia, Lithuania, Romania, Slovakia, Slovenia, and Sweden: €24, free from €100

Adara Home does not ship orders to Ceuta, Melilla, or the Canary Islands.

If you are not at home, the delivery company will leave a notification with a phone number to arrange a new delivery within a maximum period of 10 days.

At Adara Home, we track each order, so if any issue arises with your shipment, we will inform you as soon as possible.
If a delivery date has been agreed upon with you and delivery cannot be made because you are not at home, additional charges for a second delivery may apply.

THE CARRIER IS NOT OBLIGATED TO DELIVER THE MATERIAL TO YOUR HOME

4. PAYMENT

Adara Home offers 3 different payment methods. Once you have placed the order, the system will indicate which payment methods are available, and you only need to follow the instructions provided.

Bank Transfer: You can also choose bank transfer as a payment method. Our bank is La Caixa.

Credit Card: You can make your payment by credit card by selecting this option on the payment screen. This option connects to a secure server.

 

PayPal: You can also choose PayPal as a payment method.

5. PRICES

All prices and rates derived from services provided through our website Adara Home WILL include value-added tax.

6. EXCHANGES AND RETURNS

All Adara Home products are guaranteed against any manufacturing defect. To know the warranty period, you must check each product page where we inform you of the warranty validity period against manufacturing defects.

In case of manufacturing defects, Adara Home will replace the product with another provided that the claim is documented at info@adarahome.com or any other legally valid means, attaching photos or videos of the mentioned defects. In this case, you will not bear any cost.

Promotions or discounts applied to the initial order, or any other promotion in force at the time of the exchange, will not apply to product exchanges.

If there is no manufacturing defect and you wish to exercise our 30-night trial guarantee by replacing the mattress with another, Adara Home informs you that:

  • If the price of the new selected product is lower, Adara Home will refund the difference.

  • If the price of the new selected product is higher, you must pay the difference for the exchange to be carried out.

  • You may exchange the mattress for one of the same nature and size.

  • The transport cost for exchanges or returns within the first 14 calendar days after receipt is your responsibility and is €50 (per product) for any mattress exchange or return in mainland Spain, and €70 (per product) for the Balearic Islands, Andorra, and Portugal, provided the products are in their original packaging and have not been used.

  • Exceptional satisfaction guarantee: The cost of exchange in this case, within the first 30 calendar days after receipt, if the mattress has been unpacked and/or used will be €100 (per product) for exchanges in mainland Spain and €120 (per product) in the Balearic Islands, Andorra, and Portugal.

The 30-night trial guarantee from Adara Home applies only to mattresses. All other items on the website are excluded.

Please note that if you make use of the 30-night trial guarantee, the replacement mattress we send will not be eligible for withdrawal, even if it is perfectly packaged.

If the exchange has been accepted by Adara Home, we will provide written instructions via email on how to prepare the mattress so that the carrier can collect it. Product collection will be carried out by the transport company, and it is the customer's responsibility to ensure that this can be done without incident and on the ground floor of the building. To accept an exchange or return, Adara Home will request photos or visual evidence showing the condition of the product. Only products in perfect condition will be accepted for exchange or return.

6.1 Right of withdrawal

In accordance with applicable regulations, if you are contracting as a consumer, you may withdraw from the contract except in cases where the law itself indicates that due to the nature of the product or certain reasons, including hygiene, the possibility of withdrawal is explicitly excluded. Adara Home lists in section 6.2 those products excluded from the right of withdrawal.

In other cases, within a period of 14 calendar days from the delivery date, you may withdraw from your order. For this, the product must be in its original packaging and must not have been used.

In this case, Adara Home will refund the full price paid for the products within 14 days after accepting the return. The consumer will bear the costs incurred for returning the product in accordance with current regulations.

We inform you that the return shipping costs will be as follows:

  • Mattresses in original packaging €50 (per unit)
  • Upholstered base (offer) in original packaging €50 (per unit)
  • Bed bases in original packaging €50 (per unit)
  • Bedding in original packaging €12 (per unit)
  • Toppers and crib mattresses in original packaging €25 (per unit)

The exercise of the right of withdrawal may be carried out by any legally accepted means. We especially provide our email info@adarahome.com so that you can inform us of your intention to exercise your right of withdrawal. To complete your withdrawal request, you must send us photos or videos of the goods so that we can verify their condition and process the request. The photos or videos must be sent before the 14 calendar days from receipt of your order expire so that Adara Home can process your withdrawal within the legally established period.

In addition to the legal right of withdrawal, Adara Home provides you with a 30-night trial guarantee under which you may exchange mattresses within 30 days from receipt.

6.2 Exceptions to the right of withdrawal

Adara Home informs you that you will not have the right to withdraw from the contract or exchange the product when the object is:

  • Bedding that is not in its original packaging and unsealed.
  • Pillows.

7. GUARANTEES

All Adara Home products are guaranteed against any manufacturing defect for a minimum of three years as established by law. In the case of a defective product, the seller must be liable for any lack of conformity that appears within three years from delivery.

The consumer and user must inform Adara Home of the lack of conformity within two months of becoming aware of it. In the case of a defective product, the seller must proceed, as appropriate, with repair, replacement, price reduction, or contract termination, actions that will be free of charge for the consumer and user.

To find products with a longer warranty period, you must check each product page where the warranty validity period is indicated.

8. PERSONAL DATA PROTECTION

In accordance with Law 15/1999 of December 13 on the Protection of Personal Data, we inform you that your personal data, which may be included in this communication, are incorporated into an automated file under the responsibility of Adara Home, S.L., Tax ID: B95767919. The purpose of this file is to manage the business relationship and inform you of our services. This data will not be transferred to third parties.

Likewise, to access some services offered by Adara Home, S.L. through this website, you must provide certain personal data. In compliance with the provisions of Law 15/1999 of December 13 on the Protection of Personal Data, we inform you that by completing the form, your personal data will be incorporated and processed in the files of Adara Home, S.L. for the purpose of providing and offering our services, as well as informing you of improvements to the website.

The user accepts that all their personal data will be fully transferred to Pepper from the moment the user initiates the contracting of the deferred payment service offered by the latter when choosing the payment method. This acceptance also extends to third parties that may need access to the files for the proper execution of the contract.

9. INDUSTRIAL AND INTELLECTUAL PROPERTY

This website is the property of Adara Home, S.L. The intellectual property rights and rights of exploitation and reproduction of this website, its pages, screens, the information they contain, their appearance and design, as well as the links ("hyperlinks") established from it to other websites of any subsidiary and/or controlled company of Adara Home, S.L., are the exclusive property of the latter, unless expressly stated otherwise.

Any name, design and/or logo, as well as any product or service offered and reflected on this website, are duly registered trademarks of Adara Home, S.L., its subsidiaries and/or controlled companies or third parties.

Any improper use of them by persons other than their legitimate owner and without the express and unequivocal consent of the latter may be reported and pursued through all legal means available in the Spanish and/or EU legal system.

Third-party intellectual property rights and trademarks are appropriately highlighted and must be respected by anyone accessing this page, with Adara Home, S.L. not being responsible for the use that the USER may make of them, the sole responsibility resting with the user.

Content may only be downloaded, copied, or printed for personal and private use. It is prohibited to reproduce, transmit, modify, or delete the information, content, or warnings of this website without prior written authorization from Adara Home, S.L.

Adara Home, S.L. does not transfer ownership of its software to users. The user is the owner of the medium on which the software is recorded. Adara Home, S.L. holds all industrial and intellectual property rights, including the software. If the user transfers the software from this website to their terminal, they may not dissect it for study or decompile, translate the original object code version or its language into another code or language.

10. APPLICABLE LAW AND JURISDICTION

These general conditions are governed by Spanish law, and the Spanish Courts and Tribunals shall have jurisdiction to hear any issues arising regarding their interpretation, application, and compliance. The USER, by accepting the general conditions contained in this legal notice, expressly waives any jurisdiction that may correspond to them under the applicable Civil Procedure Law.

11. COOKIES NOTICE

We inform you that for the proper functioning of the website www.adarahome.com, owned and managed by Adara Home, S.L., the browsing system uses certain browsing data (“Cookies”) to offer a more personalized service to users. “Cookies” are small text files that the browser stores when browsing websites and applications. Information such as the IP address used by the computer to connect to the website, the URL address of the requested page, the time of connection, and other parameters related to the user’s operating system may be obtained. This information is only collected to identify the session in order to facilitate website analysis.

Adara Home, S.L. on its website only uses “cookies” from the service provided by Google Analytics, which is a web analytics service provided by Google, Inc.
