The company Adara Home, S.L. (VAT: B44513034) and registered in the Commercial Register of Castellón, volume 1771, folio 158, sheet number CS 41483, entry 1, is the owner of this website, operating under the trade name Adara Home.

These general conditions are formulated in accordance with the Civil and Commercial Codes, Law 7/1996, of January 15, on Retail Trade Regulation, Law 7/1998, of April 13, on General Conditions of Contracting, and Law 7/1995, of March 23, on Consumer Credit.
Placing an order implies the acceptance of these General Sales Conditions by the customer, as well as any other specified in the order itself.

In addition, the customer of Adara Home affirms to be of legal age and verifies as correct all the data provided for the management of their order.



1. OBJECTIVE

These General Sales Conditions are intended to define the sales modalities between Adara Home SL and the customer, from the order placement, delivery, and payment, as well as the after-sales service.



2. ORDER

The CUSTOMER can place an order through the following devices:

By email indicated on our website, info@adarahome.com.

In order to place an order, the Customer must provide us with their personal data, which will be stored in Adara Home SL's database. In case of placing another order, the data will not be requested again as the customer will have a password.

The Customer's placement of the order constitutes full and complete acceptance of the prices, the description of the products for sale, and the General Sales Conditions, as well as any other specified in the order itself.



3. DELIVERY.

Shipping costs are free for orders over €60 to the peninsula.

Adara Home does not ship orders to Ceuta, Melilla, and the Canary Islands.


If the transport agency, in this case MRW, does not locate the customer at home, they will leave a notification with a phone number to arrange a new delivery within a maximum of 10 days.
At Adara Home, we track each order, so if there is any issue with your shipment, we will notify you as soon as possible.
If, after agreeing with you on a delivery date for the goods by the transport agency, delivery cannot be made because you are not at the address, additional charges may apply for a second delivery.

THE CARRIER IS NOT OBLIGATED TO BRING THE MATERIAL INTO THE HOUSE



4. PAYMENT

Adara Home offers 3 different payment methods. After placing the order, the system will indicate the available payment method, and you just need to follow the instructions provided by the system.

Bank Transfer:

You can also choose bank transfer as a payment method. Our bank is La Caixa.

Credit Card:

You can make your payment by credit card, selecting this option on the payment screen. This option will connect to a secure server.

PayPal: 

You can also choose PayPal as a payment method. 


5. PRICES

All prices and fees related to the services provided through our website, Adara Home, INCLUDE value-added taxes.



6. CHANGES AND RETURNS

All products from Adara Home are guaranteed against any manufacturing defects. To know the warranty period, please refer to each product sheet where we inform you of the duration of the warranty against manufacturing defects.

In case of manufacturing defects, Adara Home will replace the product with another as long as the claim is documented at info@adarahome.com or any other legally valid means, attaching photos or videos of the mentioned defects. In this case, you will not incur any expenses.

Product promotions or discounts that the initial order may have received, as well as any other ongoing promotion at the time of the change, will not apply to product exchanges.

If you want to exercise our 30-night trial warranty and opt for a mattress replacement, Adara Home informs you that:

  • If the price of the new chosen product is lower, Adara Home will refund the difference.

  • If the price of the new chosen product is higher, you will need to pay the difference for the exchange to be processed.

  • You can exchange the mattress for one of the same nature and size.

  • The cost of changing or returning within the first 14 calendar days of receipt is your responsibility, amounting to €50 (per product) for mattress exchanges or returns within the Spanish peninsula, and €70 (per product) for exchanges or returns to the Balearic Islands, Andorra, and Portugal, provided the products are in their original packaging and have not been used.

  • Exceptional satisfaction guarantee: The cost of change within the first 30 calendar days of receipt, if the mattress has been unpacked and/or used will be €100 (per product) for changes in the Spanish peninsula and €120 (per product) in the Balearic Islands, Andorra, and Portugal.

The 30-night trial guarantee from Adara Home applies exclusively to mattresses. All other items on the website are excluded.

Keep in mind that if you use the 30-night trial guarantee, the replacement mattress sent to you will not have a right of withdrawal, even if it is perfectly packaged.

If the exchange has been accepted by Adara Home, you will receive written instructions via email on how to prepare the mattress for pickup by the carrier. The product will be collected by the transport company, and it is the customer's responsibility to ensure that the pickup occurs without any issues on the ground floor of the building. To process an exchange or return of a product, Adara Home will request photos or visual evidence of the product's condition. Only products in perfect condition will be eligible for exchanges or returns.

6.1 Right of Withdrawal

In accordance with applicable regulations, if you are a consumer, you may withdraw from the contract except in cases where the law explicitly excludes the possibility of withdrawal due to the nature of the product or other reasons, including hygiene. Adara Home specifies the products excluded from the right of withdrawal in section 6.2.

In other cases, within 14 calendar days from the date of delivery, you may withdraw from your order. For this, the product must be in its original packaging and unused.

In this case, Adara Home will refund the full price paid for the products within 14 days of accepting the return. The consumer will be responsible for the costs incurred in returning the product in accordance with current regulations.

Transport costs for returns are as follows:

  • Mattresses in their original packaging: €50 (per unit)
  • Offer upholstered base in its original packaging: €50 (per unit)
  • Bed bases in their original packaging: €50 (per unit)
  • Bedding in its original packaging: €12 (per unit)
  • Toppers and crib mattresses in their original packaging: €25 (per unit)

The right of withdrawal can be exercised through any legally accepted means. You can use our email address info@adarahome.com to communicate your intention to exercise your right of withdrawal. To complete your withdrawal, you need to send photos or videos of the merchandise so that we can assess its condition and process the withdrawal within the legal timeframe.

In addition to the legal right of withdrawal, Adara Home provides a 30-night trial guarantee in which you can exchange mattresses within 30 days of receipt.

6.2 Exceptions to the Right of Withdrawal

Adara Home informs you that you will not have the right to withdraw from the contract or exchange the product when the object of the contract is:

  • Bedding that is not in its original packaging and unsealed.
  • Pillows.

7. WARRANTIES

All products from Adara Home are guaranteed against any manufacturing defects for a minimum of three years as required by law. In case of a defective product, the seller must respond to non-conformities that arise within three years from delivery.

The consumer must inform Adara Home of non-conformities within two months from becoming aware of them. In the case of a defective product, the seller must proceed, as appropriate, with repair, replacement, price reduction, or contract resolution, all of which will be free of charge for the consumer.

8. PROTECTION OF PERSONAL DATA

In accordance with Law 15/1999, of December 13, on the Protection of Personal Data, you are informed that your personal data, which may be contained in this communication, are incorporated into an automated file under the responsibility of Adara Home, S.L., VAT: B95767919. The purpose of this file is to manage the business relationship and inform you of our services. These data will not be transmitted to third parties.

Furthermore, to access some services offered by Adara Home, S.L. through this website, you may need to provide certain personal data. In compliance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, we inform you that, by completing the form, your personal data will be incorporated and processed in the files of Adara Home, S.L. for the purpose of providing and offering our services, as well as informing you of improvements to the website.

The user accepts that all personal data are fully transferred to Pepper from the moment the user initiates the deferred payment service offered by the latter when choosing the payment method. This acceptance extends to third parties who may need to access the files for the successful completion of the contract.

This website is owned by Adara Home, S.L. Intellectual Property rights and rights of exploitation and reproduction of this website, its pages, screens, the information they contain, their appearance, and design, as well as the links ("hyperlinks") established from it to other websites of any subsidiary and/or controlled company of Adara Home, S.L., are the exclusive property of Adara Home, S.L., unless expressly specified otherwise.

Any name, design, and/or logo, as well as any product or service offered and reflected on this website, are duly registered trademarks of Adara Home, S.L., its subsidiary and/or controlled companies, or third parties.

Any improper use by individuals other than the legitimate owner and without the express and unequivocal consent of the latter may be reported and pursued through all the legal means established in the Spanish and/or community legal system.

Third-party intellectual property rights and trademarks are properly highlighted and must be respected by anyone accessing this page. Adara Home, S.L. is not responsible for any use that THE USER may make in this regard, and the sole responsibility lies with the user.

Downloading the content, copying, or printing any page of this website is only allowed for personal and private use. Reproduction, transmission, modification, or deletion of information, content, or warnings from this website without the prior written authorization of Adara Home, S.L. is prohibited.

These general conditions are governed by Spanish law, with the courts and tribunals of Spain having jurisdiction over any matters arising from the interpretation, application, and fulfillment of these conditions. THE USER, by accepting the general conditions outlined in this legal notice, expressly waives any jurisdiction that, according to the current Spanish Civil Procedure Law, may apply.
